The rules

How it works.

Under the Agency Workers Regulations 2010, a temp who works 12 continuous calendar weeks in the same role with the same client is entitled to the same basic pay and working conditions as if the client had hired them directly. The rights start on the first day of week 13.

A calendar week counts if they work any part of it. Weeks with no work at all are treated as ACAS sets out:

  • Pause the clock: any break of 6 weeks or less; sickness, injury or jury service of up to 28 weeks; annual leave; the client's usual shutdowns; strikes and lock-outs.
  • Reset it to zero: a break of more than 6 weeks for another reason, or sickness or jury service over 28 weeks. A move to a substantively different role, or to a new client, also resets it; this tool assumes neither happened.
  • Count as weeks worked: pregnancy, childbirth, maternity, adoption and paternity leave.

Enter breaks as whole weeks. A week with even one day worked counts as worked. The Regulations also have anti-avoidance rules on structuring assignments to stop a worker reaching 12 weeks; this tool doesn't apply them.

A guide, not legal advice. It applies the rules as written to the dates and figures you enter. Your own terms and the facts of a case can change the answer; if money or a dispute turns on it, check with an employment lawyer.
